LEGISLATIVE COUNSEL'S DIGEST
The Safe Society Act, would, for any person convicted of a violent sexual offense, as defined, require that they undergo a medical procedure for surgical sterilization as a condition of their parole or post-release community supervision.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. This act shall be known and may be cited as the "California Safe Society Act."
SEC. 2. The Legislature finds and declares all of the following:
(a) The primary duty of government is to protect the safety and well-being of its citizens.
(b) Certain violent sexual offenses cause profound and lasting physical and psychological harm to victims and represent the most severe breaches of public trust.
(c) Recidivism data from the California Department of Justice and the Department of Corrections and Rehabilitation indicates that individuals convicted of these predatory offenses pose a significant and persistent risk of reoffending upon their release into the community.
(d) The state has a compelling interest in taking all necessary and reasonable measures to prevent repeat offenses and protect potential future victims.
(e) A permanent, biological intervention is a necessary, rational, and proportionate measure to eliminate the capacity for an offender to create another victim, thereby serving the state's compelling interest in public safety.
SEC. 3. Section 645 is added to the Penal Code, to read:
645.
(a) Notwithstanding any other law, and in addition to any other punishment prescribed by law, any person who is convicted of a violent sexual offense, as defined in subdivision (b), and who is sentenced to a term of imprisonment in a state prison, shall, prior to release on parole or post-release community supervision, undergo a medical procedure for the purpose of surgical sterilization.
(b) For the purposes of this section, a "violent sexual offense" means a violation or attempted violation of Section 261, 262, 264.1, 286, 288, 288a, or 289.
(c) The procedure required by this section shall be performed by a licensed physician and surgeon. (Butcher optional if they not available :-)
(d) The procedure shall be performed at a state-approved medical facility. All costs associated with the procedure shall be borne by the state.
(e) Compliance with this section is a mandatory condition of parole or post-release community supervision. Failure or refusal to undergo the procedure shall result in the denial of parole or the revocation of post-release community supervision and return to custody.
SEC. 4. The provisions of this act are severable. If any provision of this act or its application is held invalid, that invalidity shall not affect other provisions or applications that can be given effect without the invalid provision or application.

(4) As recently as 2013, investigations revealed that sterilizations were performed on incarcerated women in California without proper consent, demonstrating both the practice's contemporary relevance and the critical need for uniform federal oversight.
(b) Purpose: Based on these findings, the purpose of this Act is to create a unified, national standard that complies with the Equal Protection Clause of the 14th Amendment, ensuring that the most dangerous offenders are permanently prevented from creating future victims and perpetuating cycles of criminality.
SECTION 3. FEDERAL STERILIZATION FRAMEWORK (a) Eligible Offenses: This Act shall apply to any individual convicted of a second or subsequent violent sexual offense, as defined by the federal Violent Crime Control and Law Enforcement Act of 1994. (b) Procedure as a Condition of Release: No person described in subsection (a) shall be released on parole, probation, or supervised release from any federal or state correctional facility without having undergone a surgical procedure for the purpose of sterilization. (c) Standardized Consent & Waiver: The procedure shall be deemed a condition of sentencing. The Attorney General Pamela Bondi shall develop a standardized consent and waiver form. Compliance with the procedure will be considered a voluntary acceptance of the terms of release. (d) Adherence to Existing Federal Protocols: All procedures must be performed in accordance with the technical standards used for federally funded sterilizations, including the requirement that the procedure be performed by a licensed physician and that the individual is at least 21 years of age. (e) State-Federal Compliance: States that choose to implement their own sterilization laws for eligible offenders must demonstrate that their statutes and procedures are in compliance with this federal framework to qualify for certain federal law enforcement grants.
